2. What SiamNode Is — and Is Not / SiamNode คืออะไร และไม่ใช่อะไร

EN — SiamNode is an information and discovery service. It helps people — in particular expatriates and residents in Thailand — discover, compare, and connect with local businesses and service providers ("Providers"). SiamNode uses artificial intelligence to summarise and organise publicly available and Provider‑submitted information. SiamNode is not a marketplace. We do not sell, resell, broker, or supply any of the goods or services listed. We do not process payments, hold money in escrow, take commissions on transactions, or act as an agent for any Provider or user. We are not a party to any quotation, agreement, booking, or transaction between you and a Provider.

3. Definitions / คำนิยาม

EN — "User**"**** / ****"**you" — anyone who accesses the Service, including people searching for services and Providers. "Provider" — a business or individual listed on the Service. "Listing" — a profile page for a Provider. "Claimed Listing" — a Listing whose ownership a Provider has claimed and SiamNode has confirmed.

4. Eligibility and Accounts / คุณสมบัติและบัญชีผู้ใช้

EN — You must have the legal capacity to enter into these Terms (in Thailand, generally the age of majority). If you create an account, you are responsible for keeping your credentials secure and for all activity under your account, and you agree to provide accurate information and keep it current. (Lawyer: confirm minimum‑age wording.)

5. Listings, AI Summaries, and Accuracy / รายการ บทสรุปจาก AI และความถูกต้อง

EN — Listings may contain factual business information together with AI‑generated summaries produced by SiamNode. While we aim to be useful, we do not warrant that any Listing, summary, opening hours, price, location, or other information is accurate, complete, current, or reliable. Information may come from public sources or from Providers and may be outdated or incorrect. You should independently verify any information and contact the Provider directly before relying on it.

6. The "Verified Owner" Badge / ตราสัญลักษณ์ "Verified owner"

EN — A "Verified owner" badge on a Listing means only that the business owner has claimed the Listing and that SiamNode has confirmed that claim of ownership. It is not an endorsement, certification, background check, licensing check, quality assessment, or guarantee of the Provider, its services, or its conduct. SiamNode does not vet, inspect, or guarantee any Provider.

7. Dealings Between Users and Providers / ความสัมพันธ์ระหว่างผู้ใช้กับผู้ให้บริการ

EN — Any quotation, scope of work, pricing, payment, scheduling, contract, and the service itself are arranged and carried out directly between you and the Provider. SiamNode is not involved in, and is not responsible for, these dealings. You acknowledge that:

• SiamNode does not guarantee the availability, quality, safety, legality, or suitability of any Provider or its services;

• any contract you enter into is solely between you and the Provider; and

• any dispute, claim, loss, or damage arising from your dealings with a Provider is between you and that Provider, and — to the maximum extent permitted by law — you release SiamNode from such claims. We encourage you to use your own judgement and take normal precautions when engaging any Provider.

TH — การเสนอราคา ขอบเขตงาน ราคา การชำระเงิน การนัดหมาย สัญญา และตัวบริการเอง เป็นการตกลงและดำเนินการ โดยตรงระหว่างท่านกับผู้ให้บริการ SiamNode ไม่มีส่วนเกี่ยวข้องและไม่รับผิดชอบต่อการดำเนินการดังกล่าว ท่านรับทราบว่า:

• ข้อพิพาท ข้อเรียกร้อง ความเสียหาย หรือความสูญเสียใด ๆ ที่เกิดจากการติดต่อกับผู้ให้บริการเป็นเรื่อง ระหว่างท่านกับผู้ให้บริการรายนั้น และเท่าที่กฎหมายอนุญาตสูงสุด ท่านปลดเปลื้อง SiamNode จากข้อเรียกร้องดังกล่าว เราขอแนะนำให้ท่านใช้วิจารณญาณของท่านเองและใช้ความระมัดระวังตามสมควรในการว่าจ้างผู้ให้บริการ

8. Acceptable Use / การใช้งานที่ยอมรับได้

EN — You agree not to: use the Service unlawfully or for any unlawful purpose; scrape, copy, or harvest data except as expressly permitted; misrepresent your identity or a business; post false, defamatory, infringing, or harmful content; interfere with or attempt to gain unauthorised access to the Service or its systems; or use the Service to harass or harm others.

9. Provider Listings, Claims, and Removal / รายการ การยืนยันสิทธิ์ และการนำออก

EN — Providers may claim their Listing; by doing so they agree to the SiamNode Provider Agreement [link]. A Provider (or an authorised representative) may request correction or removal of its Listing as set out in our Removal & Opt‑Out Policy [link]. SiamNode may add, edit, suspend, or remove any Listing at its discretion, including to comply with law or these Terms.

10. Intellectual Property / ทรัพย์สินทางปัญญา

EN — The Service — including its software, design, text, and the SiamNode name and logo — is owned by SiamNode or its licensors and is protected by law. We grant you a limited, non‑exclusive, non‑transferable, revocable licence to use the Service for its intended purpose. You may not copy, modify, distribute, or create derivative works except as permitted. Content submitted by Providers remains theirs, subject to the licences granted in the Provider Agreement.

EN — The Service may link to or work with third‑party services — for example, opening a mapping application such as Google Maps or Apple Maps to provide directions. Your use of those services is governed by their terms and policies. SiamNode is not responsible for third‑party services.

EN — To the maximum extent permitted by applicable law, the Service and all information on it are provided "as is"** and "as available," without warranties of any kind,** whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non‑infringement. We do not warrant that the Service will be uninterrupted, error‑free, or secure.

Lawyer note: the Consumer Protection Act and the Unfair Contract Terms Act B.E. 2540 may limit how far these disclaimers apply to consumers — to be adjusted.

13. Limitation of Liability / ข้อจำกัดความรับผิด

EN — To the maximum extent permitted by applicable law, SiamNode and its directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, nor for any loss of profits, data, or goodwill, nor for any damages arising from your dealings with any Provider or from your use of (or inability to use) the Service.

Lawyer note: set any aggregate liability cap and confirm enforceability under Thai law; mandatory consumer protections cannot be excluded.

EN — To the extent permitted by law, you agree to indemnify and hold harmless SiamNode from claims, liabilities, damages, and expenses arising out of your use of the Service, your content, your dealings with Providers, or your breach of these Terms.
