• “the Website” means the siamnode.com platform, which acts as an intermediary medium and a source of listings advertising various goods and services, using the intelligent search and information-presentation tool “AI-powered discovery”, a technology developed by the Company and to which the Company holds the rights under the law.
• “Provider” means a natural person or juristic person who is the owner of goods or services whose listing information is published on the Website, whether such information was listed by the Provider itself (whether identity-verified or not yet identity-verified) or is public information that the Website has collected and displayed for the purpose of preliminary search.
• “Customer” means a user who has registered as a member of the Website for the purpose of searching for, contacting, or entering into transactions with a Provider.
• “Visitor” means a member of the general public who accesses or uses the Website for the purpose of searching for information or communicating, without having registered as a member.

However, the Website disclaims liability for, and has no involvement whatsoever in, the entering into of any transaction, agreement, warranty, resulting image or appearance, or payment between “Providers”, “Customers” and “Visitors”.
• The decision to enter into a transaction is the discretion and the direct responsibility of each contracting party. The Website does not act as an intermediary for receiving payment, as a distributor, or as a broker in any manner.

• Use of, or receipt of services on, the Website is subject to the condition that the Provider, the Customer and the Visitor must accept the terms and conditions of this agreement without any modification or exception.
• Your accessing, using, listing on, communicating through, registering as a member of, clicking any command menu on, or clicking through to the next page of the Website shall be deemed an acceptance having effect equivalent to an electronic signature under the law.
• Such declaration of intent constitutes evidence that you have read, understood and agreed to comply with all of these terms and conditions, as well as with all policies of the Website, thereby creating an obligation that is legally binding, valid and irrevocable.

Section 2. Membership Registration and Service Fees (for Providers) / ข้อ 2. การสมัครสมาชิกและค่าบริการ (สำหรับผู้ให้บริการ)

EN — The Provider confirms and warrants that it has the capacity to enter into juristic acts and the legal authority to bind itself or the juristic person which it represents under this agreement.

EN — 2.2 Membership Fees and Refund Conditions

• The Provider agrees to pay the membership fee (Membership Fee) or special service fees at the rates, on the conditions, and through the channels prescribed by the Website.
• Once a service cycle has commenced, the Website reserves the right not to refund the service fee for that cycle in any case, whether or not the Provider uses the service for the full period, unless the cause is a direct error of the Website’s payment system, or unless it is in accordance with promotional conditions stated in writing in advance.
• The Provider may cancel the renewal of the service for the next cycle at any time before the due date, so as to avoid being charged the service fee in the next billing cycle.

Section 3. Requirements and Standards for Listing Goods and Services / ข้อ 3. ข้อกำหนดและมาตรฐานการลงประกาศสินค้าและบริการ

EN — 3.1 Information Concerning Goods and Services

• The Provider must list goods or services only within the business category that has been approved through identity verification. If the Provider wishes to change its business category, it must submit a request and undergo the identity verification process again. In this regard, it is strictly prohibited to alter or amend the details of an existing listing for the purpose of changing it into a different type of business.
• The text used in a listing must be clear and straightforward, and must not be ambiguous or cause misunderstanding on the part of consumers.
• Where goods or services include complimentary items or additional privileges, the Provider must state the details and conditions of such items in the listing in full.

• ผู้ให้บริการต้องลงประกาศสินค้าหรือบริการเฉพาะภายในประเภทธุรกิจที่ได้รับอนุมัติผ่านการยืนยันตัวตนแล้วเท่านั้น หากมีความประสงค์จะเปลี่ยนประเภทธุรกิจ จะต้องยื่นเรื่องและผ่านกระบวนการยืนยันตัวตนใหม่ ทั้งนี้ ห้ามดัดแปลงหรือแก้ไขรายละเอียดประกาศเดิมเพื่อเปลี่ยนไปเป็นธุรกิจประเภทอื่นโดยเด็ดขาด
• ข้อความที่ใช้ในประกาศต้องมีความชัดเจน ตรงไปตรงมา และไม่คลุมเครือหรือก่อให้เกิดความเข้าใจผิดแก่ผู้บริโภค
• กรณีที่สินค้าหรือบริการมีรายการของแถมหรือสิทธิพิเศษเพิ่มเติม ผู้ให้บริการจะต้องระบุรายละเอียดและเงื่อนไขของรายการดังกล่าวไว้ในประกาศให้ครบถ้วน

EN — 3.2 Images and Accompanying Media

• Images of goods or products must be clear and appropriate, and must directly convey the actual condition or the properties of those goods.
• Product descriptions, label images, or statutory certification documents must be accurate and in accordance with the relevant laws.
• It is prohibited to use any images or information of another person in a listing without consent or without authorisation under the law.

• รูปภาพสินค้าหรือผลิตภัณฑ์ต้องมีความคมชัด เหมาะสม และสื่อถึงสภาพที่แท้จริงหรือคุณสมบัติของสินค้านั้น ๆ โดยตรง
• คำอธิบายสินค้า ภาพฉลาก หรือเอกสารการรับรองตามกฎหมาย ต้องมีความถูกต้องและเป็นไปตามกฎหมายที่เกี่ยวข้อง

EN — 3.3 Statement of Price

• Where the price of goods or services is stated in a listing, the price must be stated clearly.
• Where complimentary items are offered, the Provider must clearly display the value and the conditions of such complimentary items in accordance with the law on consumer protection and other relevant laws.

EN — 3.4 Contact Information

• The Provider must state contact information that is true, accurate, and current information through which the Provider can genuinely be contacted.

EN — 3.5 Prohibited Goods and Services (Prohibited Items)

EN — The Provider agrees and warrants that it shall under no circumstances enter into the Website’s system any information, images or text having the character of, or relating to, the following goods and services.

TH — ผู้ให้บริการตกลงและให้คำรับรองว่าจะไม่นำเข้าข้อมูล รูปภาพ หรือข้อความใด ๆ อันมีลักษณะหรือเกี่ยวข้องกับสินค้าและบริการดังต่อไปนี้เข้าสู่ระบบของเว็บไซต์โดยเด็ดขาด

• Goods that infringe intellectual property: works infringing copyright, trademarks or patents.
• Illegal signal-receiving equipment: television receiver boxes operating via the internet, cable or satellite that have not been certified by the NBTC.
• Chemicals and hazardous products: chemicals with severe effects (such as insecticides) and products containing stem cells (Stem Cell) in any form.
• Property forfeited from pawn: any items or goods obtained from the forfeiture of pawned property of any kind.
• Illegal goods and goods contrary to morality: narcotics, alcoholic beverages, tobacco, weapons, pornographic material, gambling equipment, as well as human body parts or organs.
• Uncertified goods: consumer products or ready-to-eat foods without a food registration number (FDA).
• Academic documents and educational qualifications: the sale and purchase of degree certificates and diplomas, as well as services undertaking for hire the writing of theses and research works.
• Vehicles without valid title documents: motor vehicles without a registration book from the Department of Land Transport, assembled-and-registered vehicles, invoice vehicles, tax-evading vehicles, unregistered grey-market vehicles, vehicles forfeited from pawn, and vehicles under finance for which the conditions of the debt burden are not clearly stated.
• Reserved wild animals and protected wild animals: all species of animals protected by law, whether alive, as carcasses, or as any parts thereof.
• Financial instruments: the offering for sale of shares, securities, or financial title documents of any kind.
• Tracking devices (GPS Tracker): devices without a distribution licence from the NBTC, or not authorised for installation by the Department of Land Transport.
• Brand-specific direct-sales products: Amway brand goods in new (first-hand) condition.
• Reserved timber: all types of timber reserved by law, whether processed or not yet processed, for which there is no permit document valid under the law.
• Certain health and beauty products: medicines, dietary supplements, medicines for cosmetic purposes, and cosmetics that are illegal or unauthorised.
• Cannabis and hemp: every part of the cannabis or hemp plant, including extracts or processed products containing such ingredients.
• Firearm imitations: devices simulating the characteristics of firearms of any kind, such as BB Gun, Blank Gun, Cap Gun or Model Gun.
• Pyramid scheme businesses: network businesses whose fundraising characteristics amount to a pyramid scheme.
• Misleading income advertising: job recruitment listings or online income-earning listings that are deceptive or exaggerated in nature.
• Financial services: the extension of credit, loan services, guarantees, or financial transactions of any form.
• Certain property transactions: pawnbroking services, mortgage services, or sale with right of redemption of immovable and movable property of any kind.
• Controlled goods: goods that are subject to control and have not yet been authorised to be advertised under specific legislation.

• สินค้าผิดกฎหมายและขัดต่อศีลธรรม สิ่งเสพติด เครื่องดื่มแอลกอฮอล์ ยาสูบ อาวุธ สื่อลามกอนาจาร อุปกรณ์การพนัน รวมถึงชิ้นส่วนหรืออวัยวะของมนุษย์
• สินค้าไม่ผ่านการรับรอง ผลิตภัณฑ์อุปโภคบริโภค หรืออาหารสำเร็จรูปที่ไม่มีเลขสารบบอาหาร (อย.)
• เอกสารวิชาการและวุฒิการศึกษา การซื้อขายปริญญาบัตร ประกาศนียบัตร รวมถึงบริการรับจ้างทำวิทยานิพนธ์และงานวิจัย
• ยานพาหนะที่ไม่มีเอกสารสิทธิ์ถูกต้อง รถยนต์ที่ไม่มีคู่มือจดทะเบียนจากกรมการขนส่งทางบก รถจดประกอบ รถอินวอยส์ รถหนีภาษี รถเกรย์มาร์เก็ตที่ไม่มีทะเบียน รถหลุดจำนำ และรถติดไฟแนนซ์ที่ไม่มีการระบุเงื่อนไขภาระหนี้อย่างชัดเจน
• สัตว์ป่าสงวนและสัตว์ป่าคุ้มครอง สัตว์ที่ได้รับการคุ้มครองตามกฎหมายทุกชนิด ทั้งในสภาพที่มีชีวิต ซากสัตว์ หรือชิ้นส่วนใด ๆ
• ตราสารทางการเงิน การเสนอขายหุ้น หลักทรัพย์ หรือเอกสารสิทธิทางการเงินทุกประเภท
• อุปกรณ์ติดตามตัว (GPS Tracker) อุปกรณ์ที่ไม่มีใบอนุญาตจำหน่ายจาก กสทช. หรือไม่ได้รับอนุญาตให้ติดตั้งจากกรมการขนส่งทางบก
• ผลิตภัณฑ์ขายตรงเฉพาะแบรนด์ สินค้าแบรนด์ แอมเวย์ (Amway) ในสภาพของใหม่ (มือหนึ่ง)
• ไม้หวงห้าม ไม้หวงห้ามตามกฎหมายทุกชนิด ทั้งที่แปรรูปแล้วและยังไม่แปรรูป ซึ่งไม่มีเอกสารอนุญาตถูกต้องตามกฎหมาย
• ผลิตภัณฑ์เพื่อสุขภาพและความงามบางประเภท ยารักษาโรค อาหารเสริม ยาเพื่อความงาม และเครื่องสำอางที่ผิดกฎหมายหรือไม่ได้รับอนุญาต
• กัญชาและกัญชง ทุกส่วนของพืชกัญชา กัญชง รวมถึงสารสกัดหรือผลิตภัณฑ์แปรรูปที่มีส่วนผสมดังกล่าว
• สิ่งเทียมอาวุธปืน อุปกรณ์ที่จำลองลักษณะของอาวุธปืนทุกประเภท เช่น BB Gun, Blank Gun, Cap Gun หรือ Model Gun
• ธุรกิจแชร์ลูกโซ่ ธุรกิจเครือข่ายที่มีลักษณะการระดมทุนเข้าข่ายแชร์ลูกโซ่
• โฆษณาชวนเชื่อด้านรายได้ ประกาศรับสมัครงานหรือหารายได้ออนไลน์ที่มีลักษณะหลอกลวงหรือโอ้อวดเกินจริง
• บริการทางการเงิน การปล่อยสินเชื่อ บริการเงินกู้ การค้ำประกัน หรือการทำธุรกรรมทางการเงินทุกรูปแบบ
• ธุรกรรมด้านทรัพย์สินบางประเภท บริการรับจำนำ รับจำนอง หรือการขายฝากอสังหาริมทรัพย์และสังหาริมทรัพย์ทุกประเภท
• สินค้าควบคุม สินค้าที่อยู่ภายใต้การควบคุมและยังไม่ได้รับอนุญาตให้ทำการโฆษณาตามกฎหมายเฉพาะเรื่อง

EN — In this regard, the Website reserves the right to inspect, amend, suspend or delete any listing that violates the foregoing requirements, without prior notice and without any refund of any service fee whatsoever.

Section 4. Responsibilities of the Provider and Rights of the Website / ข้อ 4. ความรับผิดชอบของผู้ให้บริการและสิทธิของเว็บไซต์

EN — 4.1 Warranty of the Provider’s Rights and Ownership

EN — The Provider warrants that the information, images and various details used in a listing (including but not limited to photographs, text, or typefaces) are true and accurate information, and that the Provider is the holder of the rights or the ownership, or has obtained the right to use them fully and lawfully.

TH — ผู้ให้บริการให้คำรับรองว่า ข้อมูล รูปภาพ และรายละเอียดต่าง ๆ ที่ใช้ในประกาศ (รวมถึงแต่ไม่จำกัดเพียง รูปถ่าย ข้อความ หรือรูปแบบตัวอักษร) เป็นข้อมูลที่ถูกต้องแท้จริง โดยผู้ให้บริการเป็นผู้ถือสิทธิ กรรมสิทธิ์ หรือได้รับสิทธิในการใช้งานอย่างสมบูรณ์ตามกฎหมาย

EN — 4.2 Prohibition on Copying or Infringing Intellectual Property

EN — The Provider is prohibited from publishing any information, images or details that have been adapted, reproduced or copied from other sources of information, or from the websites of other persons, without authorisation.
